These Terms of Service ("Terms") govern your access to and use of the Tprice mobile application and related services (collectively, the "Service") provided by NIKITA IARUNIN PR BEOGRAD, a sole proprietor (preduzetnik) registered in the Republic of Serbia (Belgrade), trading as Tprice ("we", "us", "our"). By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy describes how we collect and use personal data. By using the Service, you also acknowledge that you have read our Privacy Policy.

1. Eligibility

The Service is intended for users who are at least 18 years old. If you are under 18, you must not use the Service. By using the Service, you represent that you meet this requirement.

2. Description of the Service

Tprice is a price comparison and product information tool for grocery shopping. Depending on your settings, the Service may cover Serbia and/or Croatia, including:

  • Search and browse products and compare prices across participating retailers.
  • Barcode scanning (where supported) to find products and prices.
  • Product detail pages, which may include information enriched from third-party sources (e.g. product images, nutrition or Nutri-Score-style data where available).
  • Favorites, price history (including chart views), and price alerts.
  • Store / retailer lists and location-assisted features (where you grant permission), to help show relevant retailers or offers.

Important: Tprice does not sell groceries or other goods. We do not guarantee that any price, promotion, or product information shown in the app matches the price or availability at a physical store at any given time. The Service is informational only.

3. Price and product data; no warranty of accuracy

3.1 Sources. Price and assortment data are compiled from official or aggregated sources configured for each region (for example, open government price datasets for Serbia and aggregated retail price archives for Croatia). Product details may be enriched using databases such as Open Food Facts and similar providers, as described in our Privacy Policy and in Section 19 (Data sources and attributions).

3.2 Delays and errors. Data may be incomplete, delayed, or incorrect due to import schedules, technical errors, or changes at retailers. VAT, promotions, regional differences, and in-store-only offers may not always be reflected.

3.3 No reliance. You agree that you use the Service at your own risk for planning purposes only. You should verify prices and product suitability (including allergens and dietary needs) before purchasing in store.

4. Accounts and authentication

4.1 Certain features require an account. Authentication may be provided via third-party identity providers (e.g. sign-in services operated by Apple, Google, or others as offered in the app).

4.2 You agree to provide accurate information and to keep your credentials secure. You are responsible for activity under your account unless you notify us of unauthorized use.

4.3 Account deletion. You may request deletion of your account and associated personal data as described in our Privacy Policy (e.g. via Profile → Account settings → Delete account where available, or by contacting us at the email above). We will process requests in line with our Privacy Policy and applicable law. Some information may be retained where required by law or for our legitimate interests (for example, security and abuse-prevention logs), as described in our Privacy Policy.

5. Acceptable use

You agree not to:

  • Use the Service in violation of applicable law or third-party rights.
  • Attempt to scrape, reverse engineer, or overload our systems; circumvent security; or access non-public areas.
  • Use the Service to transmit malware, spam, or unlawful content.
  • Misrepresent your identity or misuse another person's account.
  • Use automated means to access the Service in a way that unreasonably impairs the Service for others.

We may suspend or terminate access if we reasonably believe you have breached these Terms or pose a risk to the Service or other users.

6. Pricing

The Service is currently provided free of charge. There are no in-app purchases and no paid subscriptions, and we do not collect any payment or financial information from you.

If we introduce paid features in the future, we will disclose the applicable terms — including price, billing, auto-renewal, and cancellation — in the app before you purchase, and update these Terms accordingly. Your mandatory statutory consumer rights (including in the European Union and United Kingdom) are not affected.

7. Push notifications and device permissions

The Service may send you a transactional push notification to let you know when we have replied to a request you submitted through the in-app "Contact us" form; this is the only push notification we send, and we do not send marketing or promotional notifications. You can disable notifications at any time in your device settings. Use of the camera (for barcode scanning) and other device permissions is explained in our Privacy Policy and requested only where needed for features you use.

8. Third-party services and content

The Service integrates third-party services (including without limitation cloud infrastructure, analytics, authentication, and product databases). Their use is subject to their respective terms and privacy policies. We are not responsible for third-party services' availability or practices, except as required by applicable law.

The Service does not display advertising and does not integrate any advertising network, as described in our Privacy Policy.

9. Intellectual property

9.1 The Service, including its design, branding, software, and compiled content (excluding third-party data and open-licensed materials), is owned by Tprice or its licensors and is protected by intellectual property laws.

9.2 Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms and app store rules.

9.3 You must not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted by law or by us in writing.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow certain disclaimers; in those cases, our liability is limited to the maximum extent permitted.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TPRICE AND ITS AFFILIATES, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON PRICE OR PRODUCT INFORMATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO TPRICE FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY EUROS (EUR 50), EXCEPT WHERE MANDATORY LAW (INCLUDING EU CONSUMER LAW) REQUIRES OTHERWISE.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Tprice from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or breach of these Terms, except where such claims result from our gross negligence or wilful misconduct.

13. Changes to the Service and to these Terms

We may modify the Service or these Terms. We will post updated Terms at https://www.tprice.app/ (or another URL we communicate) and update the "Last updated" date. Material changes may be communicated via the app or email where required by law. Continued use after the effective date constitutes acceptance, except where your explicit consent is required by law.

14. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or harms the Service, other users, or third parties, or as required by law. You may stop using the Service at any time. Provisions that by their nature should survive (including Sections 9–12, 15–18) will survive termination.

15. Apple App Store (iOS)

If you access the Service through the Apple App Store, you acknowledge that:

  • These Terms are between you and Tprice, not Apple. Apple is not responsible for the Service or its content.
  • Apple has no obligation to provide maintenance or support for the Service.
  • If the Service fails to conform to any applicable warranty, you may notify Apple; to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims relating to the Service or your possession and use of the app, including product liability, legal compliance, or consumer protection claims.
  • In the event of any third-party claim that the Service infringes intellectual property rights, Tprice (not Apple) is responsible for investigation, defence, settlement, and discharge of such claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also comply with applicable App Store Terms of Service.

16. Google Play (Android)

If you obtain the Service through Google Play, you agree that Google LLC or its affiliates are not responsible for the Service except as set out in the Google Play Terms of Service and Google Play Business and Program Policies. You must comply with those terms when using the Service.

17. European Union and UK consumers

17.1 If you are a consumer habitually resident in the European Union or the United Kingdom, you benefit from mandatory legal rights under the laws of your country, including rights relating to digital content and digital services, distance contracts, and unfair terms. Nothing in these Terms affects those rights.

17.2 Alternative dispute resolution. The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obliged to use a specific ADR body unless required by law.

17.3 Croatia and Serbia. Where you use country-specific features (e.g. Croatia or Serbia catalogues), local consumer laws may apply to you in addition to EU-wide protections where applicable.

18. General

18.1 Entire agreement. These Terms, together with our Privacy Policy and any additional terms we may present in the app, constitute the entire agreement regarding the Service.

18.2 Severability. If any provision is invalid, the remainder remains in effect.

18.3 No waiver. Failure to enforce a provision is not a waiver.

18.4 Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger or sale of assets.

18.5 Language. The English version of these Terms prevails in case of conflict with translated versions, to the extent permitted by law.

19. Data sources and attributions

Some product information shown in the Service is provided by Open Food Facts, a free, open, and collaborative database of food products (https://openfoodfacts.org).

  • Product data — such as product names, ingredients, nutrition facts, and Nutri-Score values — is taken from the Open Food Facts database, which is made available under the Open Database License (ODbL) v1.0. The individual contents of that database are made available under the Database Contents License (DbCL) v1.0.
  • Product photographs displayed in the Service are provided by Open Food Facts contributors and are licensed under the Creative Commons Attribution-ShareAlike 3.0 Unported (CC BY-SA 3.0) licence.

We use this data under the terms of those licences, which permit commercial use subject to attribution. Where we display information or a photograph for a specific product, that content and its authorship can be found on the corresponding product page on Open Food Facts. Open Food Facts and its contributors are independent of Tprice and do not endorse the Service.
